1. Acceptance of Terms

Welcome to YouMeHungry. These Terms and Conditions (“Terms”) govern your access to and use of the YouMeHungry website, mobile application, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

2. Eligibility

You must be at least 18 years old to create an account and use our Services. By registering, you represent and warrant that you have the legal capacity to enter into a binding agreement.

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorised access or security breach
  • Accept responsibility for all activities that occur under your account

4. Orders and Payments

When you place an order through the Platform:

  • You authorise YouMeHungry to charge your selected payment method for the total amount, including food, delivery fees, service fees, and applicable taxes.
  • Prices listed on the Platform are set by restaurants and are subject to change without notice.
  • All payments are processed securely through our third-party payment providers.
  • You are responsible for ensuring that your payment information is accurate and up to date.

5. Delivery

YouMeHungry facilitates delivery through independent drivers. We do not guarantee exact delivery times, as these may be affected by traffic, weather, restaurant preparation times, and other factors beyond our control.

  • You must provide accurate delivery instructions and ensure someone is available to receive the order.
  • If delivery fails due to inaccurate information or unavailability, you may still be charged for the order.
  • Contactless delivery may be available and is offered at your discretion.

6. Cancellations and Refunds

Cancellation and refund policies are as follows:

  • Orders may be cancelled before the restaurant begins preparation. Once preparation has started, cancellation may not be possible.
  • If your order is incorrect, missing items, or of unsatisfactory quality, please contact our support team within 24 hours for assistance.
  • Refunds, if approved, will be processed to the original payment method within 5–10 business days.
  • We reserve the right to refuse refund requests that we reasonably believe to be fraudulent or abusive.

7. Restaurant Partners

Restaurants listed on the Platform are independent third parties. YouMeHungry is not responsible for the quality, safety, or accuracy of menu items, allergen information, or restaurant service. Any disputes regarding food quality should be directed to the restaurant, though we will endeavour to assist in resolving issues.

8. Driver Partners

Delivery drivers are independent contractors and not employees of YouMeHungry. We do not control their actions or conduct while performing deliveries. You agree to treat drivers with respect and report any misconduct through the Platform.

9. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose
  • Impersonate any person or misrepresent your affiliation
  • Interfere with or disrupt the Platform or its servers
  • Attempt to gain unauthorised access to any part of the Platform
  • Post false, misleading, or defamatory content or reviews
  • Harass, abuse, or harm any other user, driver, or restaurant

10. Intellectual Property

All content on the Platform, including logos, trademarks, text, graphics, and software, is the property of YouMeHungry or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

11. Limitation of Liability

To the fullest extent permitted by law, YouMeHungry shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform. Our total liability for any claim shall not exceed the amount you paid for the specific order giving rise to the liability.

12. Indemnification

You agree to indemnify and hold harmless YouMeHungry, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Platform or violation of these Terms.

13. Termination

We may suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, all provisions that by their nature should survive will continue in effect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which YouMeHungry operates, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the courts of that jurisdiction.

15. Changes to These Terms

We may modify these Terms at any time. The updated Terms will be posted on this page with a revised “Last updated” date. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
